On other threads is a toasty discussion of those who violate their national security clearances and release documents ala Wikileaks.
Jonathon Pollard also came to mind.
And of course the ole Pentagon Papers case as hardly seemed secrets.
It seems natural for a group to want to keep secrets. More natural then openness.
Seems to me any prosecution for the release of documents deemed secret for National Security reasons should have to demonstrate the real harm these document releases caused and not just the embarrassment. Part of the judicial process should be to evaluate if the released material was properly held as secret under the law. Not just because it was labeled thus.
